Terms of Service

0. Abstract

These Terms of Service ("Terms") cover access to and use of nitlix.com, the shared account system, and any product or application that accepts that account for sign-in (together, the "Services").

Creating an account or otherwise using the Services means accepting these Terms. If that is not acceptable, do not use the Services.

1. Eligibility & accounts

• Minimum age: Accounts require the user to be at least 12 years old.
• Parental permission (where required): Anyone under the age of legal majority in their jurisdiction may only use the Services with a parent or legal guardian's consent and supervision. That adult is responsible for the use.
• Sign-up methods: Accounts may be created with Google, Discord, or Microsoft; with an email address; or with a passkey (WebAuthn) on a supported device. Additional sign-in methods may be linked or unlinked from settings, as long as at least one working way to sign back in remains.
• Accurate information: Information provided at signup or in settings should be accurate and kept reasonably current.
• One account, one identity: An account is a single identity used across nitlix.com and products that offer sign-in through this layer. The account holder is responsible for activity under that account, including activity inside any product reached through it.
• Sessions: Devices and sessions signed into an account are recorded (browser, OS, approximate location, last-used time) so unrecognized access can be reviewed and revoked from settings. Compromised accounts should be reported promptly using the contact below.

Access may be refused, suspended, or terminated where these Terms are reasonably believed to have been violated.

2. Use of the Services

Subject to these Terms, a limited, non-exclusive, non-transferable, revocable license is granted to access and use the Services for personal or internal business purposes — including signing into products that accept this account, and third-party applications that have integrated the same sign-in.

Users agree to:

• Use the Services only as permitted by law and these Terms.
• Respect intellectual property and other rights of the operator and third parties.
• Avoid use that harms or interferes with the operation, security, or integrity of the Services or underlying infrastructure.

3. Acceptable use

The Services may not be used to:

• Engage in illegal, fraudulent, or malicious activity.
• Harass, threaten, or harm others, or promote hate, violence, or discrimination.
• Upload content — including avatars — that is unlawful, harmful, defamatory, obscene, or otherwise objectionable.
• Attempt unauthorized access to any account, session, credential, system, or network.
• Register a passkey, link an OAuth provider, or authorize a third-party application using an identity that is not the user's own.
• Probe, scan, or test vulnerability of any system or network without prior written permission.
• Interfere with or disrupt integrity or performance of the Services, including by overloading or abusing APIs, the RPC layer, or infrastructure.
• Reverse engineer, decompile, or extract source code from the Services, except where such restrictions are prohibited by law (published open-source projects are governed by their own licenses).

Access to some or all of the Services may be suspended or terminated where this section is reasonably believed to have been violated.

4. Content & intellectual property

4.1 Service content

Software, code, designs, text, graphics, logos, and other materials provided through the Services ("Service Content") are owned by or licensed to the operator and protected by applicable law.

Source code published as open source is governed by the license in the relevant repository, not by these Terms.

Except as allowed by these Terms or an applicable open-source license, users may not:

• Copy, modify, distribute, sell, or lease any part of the Services or Service Content.
• Remove or alter copyright, trademark, or other proprietary notices.

4.2 User content

Accounts may upload and store an avatar (PNG, JPEG, WEBP, or GIF, up to 10MB by default) and, depending on the product, other files or text ("User Content"). Rights in User Content remain with the user who holds them.

By uploading User Content, the user grants a worldwide, non-exclusive, royalty-free license to host, store, reproduce, resize, and display that content solely as needed to operate, secure, and provide the Services (for example, generating resized avatar variants), and as otherwise described in the Privacy Policy.

Users are responsible for ensuring that:

• They have the rights needed to upload User Content; and
• User Content does not violate these Terms or applicable law.

Content that violates these Terms may be removed.

5. Data, privacy & security

Use of the Services is also covered by the Privacy Policy, which explains what is collected, how it is used and protected — including account, session, and device information described in Section 1 — and what rights apply. Using the Services means that policy has been read and understood.

Technical and organisational measures are in place to protect data and accounts against unauthorized access, loss, or misuse, including session tracking and support for passkeys as a phishing-resistant sign-in method. No system is guaranteed fully secure. Use of the Services is at the user's own risk.

6. Changes, availability & termination

The Services may change over time. That can include:

• Adding, modifying, or removing features, products, or integrations (including individual products or specific sign-in methods).
• Suspending or discontinuing parts of the Services when needed (maintenance, security, operations, and similar).

Reasonable efforts will be made to give notice of significant changes where practical.

Users may stop using the Services or delete their account at any time. Access may be suspended or terminated if:

• These Terms or applicable law are materially or repeatedly breached.
• Law or court order requires it.
• Continuing to provide the Services is no longer commercially or technically feasible.

Where appropriate and legally permitted, notice will be attempted before suspension or termination.

7. Disclaimers

The Services and any content provided through them are offered "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied. That includes products still labelled alpha or beta, which may change or stop without the notice that would apply to a stable product.

To the fullest extent permitted by law, all warranties are disclaimed, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Any warranty that the Services will be uninterrupted, error-free, secure, or free of harmful components.
• Any warranty regarding accuracy, reliability, or completeness of content or information obtained through the Services.

Users are responsible for backing up their own data and content and for using the Services in a way appropriate to their situation.

8. Limitation of liability

To the fullest extent permitted by law, the operator and its affiliates, officers, employees, and partners will not be liable for:

• Indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, revenue, data, or goodwill.
• Damages resulting from:
  • Access to or use of, or inability to access or use, the Services;
  • Conduct or content of other users or third parties; or
  • Unauthorized access, use, or alteration of accounts, sessions, or content.

Where liability cannot be excluded, total aggregate liability arising out of or relating to the Services or these Terms is limited to the greater of:

• Amounts paid (if any) for access to the Services in the twelve (12) months before the event giving rise to the claim; or
• One hundred (100) USD.

9. Third-party services & links

Signing in with Google, Discord, or Microsoft, or authorizing a passkey, connects the account to that provider. Those providers' own terms and privacy policies apply to them. How they process data before it reaches the Services is outside this operator's control.

Accounts may also be used to sign into other products that accept this identity layer, and into third-party applications that integrate the same sign-in. Once authorized, an application may receive the account information covered by the scopes approved (for example name, email, or group membership). Use of any product or application reached that way is governed by that product's own terms, in addition to these Terms for the account itself.

The Services may link to third-party websites or content that are not controlled here. Those are not endorsed, and responsibility for them is not assumed.

10. Modifications to these Terms

These Terms may be updated from time to time. Updated versions will be posted and the "Last updated" date changed.

For material changes, reasonable steps will be taken to notify users (for example through the Services or by email, where appropriate). Continued use after the updated Terms take effect means acceptance of those Terms.

Anyone who does not agree must stop using the Services.

11. Governing law & dispute resolution

These Terms, and any dispute or claim arising out of or in connection with them or the Services, are governed by applicable law, without regard to conflict-of-law rules.

Disputes will be resolved in the courts or through mechanisms specified from time to time, except where mandatory consumer protection laws grant additional rights.
